Does My Disabled Child Qualify For Social Security Payments?

Dedicated Florida disability attorneys help families understand eligibility

Caring for a child with a disability comes with unique challenges. Every parent wants the best for their child, but for parents of disabled children it often comes at a steep price. The additional financial costs of ensuring your child’s day-to-day needs are met can severely strain a family’s budget. Especially for families with limited resources, the demands of caring for a disabled child can be overwhelming. To help fill the gap, the Social Security program provides supplemental income for children with disabilities to support their care. However, many parents are unaware of the benefits or are unsure if they qualify.

While benefits come from the national Social Security program, a state agency will determine if your child’s disability meets the eligibility requirements. To qualify, you must demonstrate that your child’s disability very seriously limits their activity and is expected to last at least one year, or result in death. There are some medical conditions that are so serious, they qualify for an expedited process known as Compassionate Allowances. Other cases will be subject to a more rigorous evaluation. This exercise is thorough and can be tough on families. Investigators may want to evaluate the medical history, look at school records, and interview you and other people who know your child.

Once the state agency determines that your child’s disability qualifies, they will calculate the monthly allowance amount the child is entitled to receive. The federal base rate for 2016 is $733 per month, though this will vary depending on the state you live in and whether the child and family meets certain income eligibility requirements. As part of that process, the Social Security Administration (SSA) will also look at the parents’ income to determine the level of need. This is called “deeming income.” The SSA disability income requirements are very detailed, but generally the more income you have the less in benefits you receive. We can evaluate your individual situation to help you understand the amount your child would likely be entitled to.

Obtaining disability benefits for a child involves two very complex processes, demonstrating the disability and then showing need. Families can wait months to hear a decision, all the while needing the supplemental income to assist with their child’s care. You should not go through this process alone. An experienced disability attorney familiar with the local evaluation process will be your greatest advantage in navigating the system.
